Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the ChatKindle platform at chatkindle.com and any related services, websites, dashboards, and APIs operated by ChatKindle Inc. (“ChatKindle”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
ChatKindle provides a multi-tenant SaaS platform that lets businesses build, train, customize, and deploy AI chatbots on their own websites. Features include knowledge-base ingestion (web crawl, PDF, manual content), an embeddable widget, analytics, integrations (booking, messaging, CRM), and billing.
We may add, change, or remove features. We'll give reasonable notice for any change that materially reduces a paid feature you depend on.
2. Accounts
- You must be at least 18 years old and able to enter a binding contract.
- You're responsible for everything that happens under your account — keep credentials safe.
- If you sign up on behalf of a business, you represent that you have authority to bind it.
- One human per login. Sharing a single account between multiple people is not permitted on paid plans.
3. Plans, billing, and renewals
- Paid plans are billed monthly or annually in advance through Razorpay (INR) or PayPal (USD and other currencies).
- Plans renew automatically on the billing date until you cancel. You can cancel anytime from the billing page; cancellation takes effect at the end of the current billing period.
- Usage limits (conversations, knowledge-base size, bots, sources) are listed on the pricing page and your billing dashboard. Overage on conversation credits blocks new conversations until the next period or until you upgrade.
- Refunds: monthly plans are non-refundable; annual plans are eligible for a prorated refund if cancelled within 14 days of first purchase.
- Taxes are your responsibility unless we're required to collect them in your jurisdiction.
- We may change prices with at least 30 days' notice. Existing paid subscribers keep their current rate until their next renewal.
4. Free plan and trials
The Free plan has hard usage caps (currently 50 chats / month, 1 bot, 200 KB knowledge base) and may be discontinued, restricted, or have rate-limited features at any time. Trials, if offered, convert to a paid plan only with your explicit confirmation.
5. Your content
You retain ownership of the content you upload (URLs, PDFs, prompts, branding assets), and the chat transcripts your bot generates on your behalf. You grant ChatKindle a limited, worldwide, royalty-free licence to host, process, transmit, and display that content solely to operate the Service for you.
You are responsible for ensuring you have the right to upload anything you upload, including any third-party material (logos, images, copy). You must not upload confidential information you are not authorised to share.
6. Acceptable use
You agree not to use the Service to:
- Send spam, phishing, scams, or unsolicited bulk messaging.
- Build chatbots that impersonate a real person without their consent.
- Generate or distribute content that is illegal, defamatory, hateful, or sexually exploitative of minors.
- Attempt to reverse-engineer, jailbreak, or otherwise circumvent the underlying LLMs' safety guardrails.
- Stress-test, scrape, scan, or probe the Service for vulnerabilities without our written permission.
- Use the Service for high-risk regulated decisions (medical diagnosis, legal advice, lending decisions) without independent professional oversight.
- Resell or white-label the Service without a separate written agreement.
Suspected violations can result in temporary suspension while we investigate. Confirmed violations can result in termination without refund.
7. AI output and accuracy
ChatKindle is powered by large language models that can produce inaccurate or unexpected output. You are responsible for reviewing the content and behaviour of your bot, especially before deploying it publicly. The Service is not a substitute for medical, legal, financial, or other professional advice. We do not warrant that bot output will be accurate, error-free, or fit for any particular purpose.
8. Privacy
Our Privacy Policy explains how we handle personal information, including under GDPR and India's DPDP Act. By using the Service you also acknowledge that policy.
9. Third-party integrations
The Service connects to third-party platforms (Google Calendar, WhatsApp, Razorpay, PayPal, OpenRouter, etc.). Your use of those platforms is governed by their own terms. ChatKindle is not responsible for outages, policy changes, or decisions made by those third parties.
10. Intellectual property
The Service, including its code, design, documentation, and trademarks, is owned by ChatKindle and our licensors. Nothing in these Terms transfers that ownership to you. We welcome feedback; you grant us a non-exclusive licence to use suggestions you send us without obligation.
11. Termination
- You can stop using the Service at any time by cancelling from the billing page or emailing support@chatkindle.com.
- We can suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal risk for us or other users.
- On termination, your data is retained for 30 days for recovery, then permanently deleted (except where statutory retention applies — see Privacy Policy §6).
12. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. To the maximum extent permitted by law, we disclaim all such warranties.
13. Limitation of liability
To the maximum extent permitted by law, ChatKindle's total liability arising out of or related to these Terms or the Service is limited to the greater of (a) USD 100 or (b) the fees you paid us in the 12 months immediately before the event giving rise to the claim. ChatKindle will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or business interruption, even if we've been advised of the possibility.
14. Indemnity
You agree to defend, indemnify, and hold harmless ChatKindle and its officers, employees, and agents from any claim, damages, or expense (including reasonable legal fees) arising from (i) your content, (ii) your use of the Service in violation of these Terms, or (iii) your infringement of any third-party right.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the courts of Mumbai, India, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in this section overrides non-waivable consumer rights you have in your country of residence.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or an in-product notice at least 14 days before they take effect. Continued use after an update means you accept the new Terms.
